Power Morcellator Lawsuit Alleges Spread Of Leiomyosarcoma
November 23, 2015 – – Tracey & Fox reports on another lawsuit filed against a laparoscopic power morcellation device, alleging that the device uncovered, accelerated, and spread one woman’s leiomyosarcoma. The lawsuit was filed by the plaintiff in New York, however, it has since been overseen by her family, as the plaintiff herself died due to the cancer. Leiomyosarcoma is a very rare form of aggressive cancer called Sarcoma, which indicates that the cancer is found within the connective tissues of the body.
In this particular case, the women underwent a hysterectomy procedure in order to remove uterine tissue that had become troublesome. To do this, surgeons used a power morcellator device. They inserted the device into the woman’s abdomen through a small incision. Once inside, the tool spun tiny blades which were designed to shred apart tissue, so that it could be removed through a tube. Recent studies show, however, that as the tool does this it can also uncover and spread previously undetected cancer cells. This spreading causes the cancer to increase in grade and become aggressive, accelerating the disease and significantly impacting the life expectancy of the patient.
In this case, the plaintiff was aware that her cancer was fatal, and therefore recorded testimony for her lawsuit before passing away. She died at the young age of 43 in September of 2015. Like many others state in allegations against the device, the woman noted that she was tested for cancer prior to surgery, and that those tests came back negative. After the surgery, however, she was diagnosed with advanced leiomyosarcoma, which continued to spread despite treatments, metastasizing in her pelvis, right abdomen, and lungs. Her suit was filed just two months before her death in the U.S. District Court for the District of New Jersey under case number 2:15-cv-05704-JLL-JAD.
As lawsuits regarding laparoscopic power morcellation began to mount, the U.S. FDA stepped forward as well, issuing a safety warning which noted that most women should refrain from using the tool during gynecological surgeries that involve uterine fibroids, due to the risk of uncovering and spreading uterine sarcomas.
