Plaintiff Files Xarelto Lawsuit Alleging Manufacturers Used Misleading Ads For Blood Thinner
January 08, 2016 – – BloodThinnerHelp.com reports on a lawsuit filed regarding recent marketing advertisements for blood thinner Xarelto, by manufacturers Bayer AG and Janssen Pharmaceuticals. Although the anticoagulant is currently subject of over 2,800 lawsuits in federal court multidistrict litigation and over 500 lawsuits in a Philadelphia mass tort group, the ads promoting it seem as prevalent, persistent, and positive as ever.
Recent ads feature the endorsements of popular celebrities, including Brian Vickers (a driver for NASCAR), Chris Bosh (an NBA player), Kevin Nealon (an alumni of SNL), and Arnold Palmer (a golf legend). In the television commercials, each celebrity discusses their experiences with the blood thinner, which, of course, focus on all of the plusses of the new blood thinner. Unlike traditional blood thinners, Xarelto doesn’t require regular monitoring and adjustments by physicians, or special diets, and it is the only blood thinner to come with a recommended one-size-fits-all, one pill per day dosage.
Plaintiffs involved in the ever-increasing surge of Xarelto lawsuits have a profoundly different perspective of the drug. They allege that it is the most dangerous blood thinner currently on the market, causing patients uncontrollable bleeding episodes and severe internal bleeding–situations which can quickly turn fatal. They also point to the fact that manufacturers were negligent to release Xarelto to the market for public use without any corresponding antidote.
This stunning lack of antidote means that if someone with Xarelto in their system begins to bleed, doctors will be unable to clot their blood and stop that bleed. In these instances, even a small bleed can turn into an emergency situation, and doctors must resort to extreme, life-saving medical treatments such as blood transfusions or surgery to stop the pressure of pooling blood. Even then, patients can die from losing too much blood.
Traditional blood thinners do not have this dangerous issue. They offer an antidote for consumers through vitamin K, which is also why they require special diets. When individuals using traditional blood thinners begin to bleed, physicians are able to treat them with vitamin K, countering the effects of the blood thinner and allowing the patient’s blood to clot. This seemingly small difference can mean life vs. death for some.
As you can see when compared with a situation like this, the special diet that Xarelto advertisements note as a ‘drawback’ suddenly seems like a non-issue. Additionally, recent studies have shown that users who switch from traditional blood thinners to Xarelto are at increased risk for stomach and eye bleeds.
The federally filed Xarelto lawsuits have been consolidated to form multidistrict litigation number 2592 and are being overseen by the Honorable Judge Eldon Fallon in the Eastern District of Louisiana. As they await trial, other lawsuits will likely be able to join them, which is why Attorney Joseph Osborne is now working to ensure that everyone negatively affected by the blood thinner will have the option of investigating their legal rights. Attorney Osborne currently offers free Xarelto consultations for affected individuals.
