Power Morcellator Lawsuit Claims Tool Caused Fatal Spread Of Uterine Cancer Leiomyosarcoma

January 11, 2016 – – Banville Law reports on a wrongful death lawsuit filed against Karl Storz, manufacturer of the power morcellator device used during the plaintiff’s gynecological surgery. The lawsuit, filed initially in the U.S. District Court for the District of New Jersey under case number 2:15-cv-05704-JLL-JAD, is pursued on behalf of the original plaintiff by family members, as she passed away shortly after filing suit.

Details of the lawsuit found in court documents state that the victim alleged that during her hysterectomy, the power morcellator exposed and disseminated uterine cancer cells, causing her to be suddenly diagnosed with a high-grade, fatal leiomyosarcoma post-surgery.

Hysterectomies are required when uterine tissue becomes troublesome or painful uterine fibroids develop. Patients have the option of using a laparoscopic power morcellator device for this procedure, which offers a less invasive surgery and faster recovery time than general open surgery. During power morcellation to remove fibroids or uterine tissue, the front of the power morcellator can slide into the abdomen through a small incision. Once inside, it rapidly spins small blades in order to shred the troublesome tissue into small pieces that are later removed from the body through a hollow tube on the device.

The family in this case, as well as many other power morcellator lawsuit plaintiffs across the nation, allege that as the device completes this procedure it can expose cancer cells that neither the patient or physician know are there, and the whipping motion of its blades can spread these cells throughout the body, creating an high-grade, accelerated cancer and significantly impacting the life expectancy of the patient involved.

In this plaintiff’s case, the cancer proved fatal. Despite multiple attempts to treat the disease, it was aggressive and only continue to spread. Leiomyosarcoma is an especially aggressive and typically rare form of cancer. One that, her family alleges, would never have developed if the cancer cells were not spread by the power morcellator tool.
