Sexual Assault Attorney Files Complaint Against Massage Envy In West Chester Pennsylvania
January 11, 2016 – – AbuseGuardian.com reports on another sexual assault complaint filed on September 17, 2015 in the Court of Common Pleas of Philadelphia County, naming Massage Envy as one of the three defendants. The case number is 1509033673 and these allegations also identify the Massage Envy location in West Chester, Pennsylvania as the location of the assault with James Deiter, the perpetrator.
Around 2013 the Plaintiff purchased a membership to Massage Envy and used it regularly throughout 2014. She attended several locations without incident, and in February 2015 she scheduled a massage at the West Chester location. Upon calling, James Deiter was recommended to her by a female employee stating: “He is the best we have.” At this point Deiter had already had one complaint made against him from a female client alleging sexual assault, which the Plaintiff was not made aware of. Deiter had been suspended for one week from his job for that incident and allowed to return to work with no restrictions.
The Plaintiff booked the massage and received several massages from Deiter from February through April without incident. In April 2015, during a massage performed by Deiter, the Plaintiff was lying on her back while having her neck, arms, and shoulders massaged. It was at this time that Deiter allegedly took the Plaintiff’s hand and secured it above her head touching his private parts on her hand. The complaint states that he simulated a sexual act and “moaned with sexual pleasure.” The document goes on to describe how Deiter pinned the Plaintiff down, not allowing her to move, while he masturbated against her hand. He then allegedly continued this aggressive sexual assault as he stood over her.
The court documents state that after this assault occurred that Deiter went on to assault another woman at the same location on May 2, 2015. This woman reported the assault to the police the same day. The police then interviewed Deiter who admitted to sexually assaulting multiple female clients, and he was arrested and charged with multiple violations.
Similar sexual assault lawsuits against Massage Envy have been filed across the country. According to court documents there are already “50 allegations of sexual assaults in as many as 15 different states.” Brian Kent expects these numbers to rise given the fact that despite Massage Envy’s advertised zero tolerance policy regarding sexual misconduct, employees with sexual assault records are allowed to continue to work with and are even recommended to female clients.
