Presiding Judge Eldon Fallon Sets Xarelto Lawsuit Bellwether Trial Dates For Early 2017
January 12, 2016 – – BloodThinnerHelp.com reports on Xarelto lawsuit Bellwether trial dates which have been scheduled for cases involved in multidistrict litigtion number 2592. These trials, which currently number over 2,800 are being overseen by Judge Eldon Fallon. According to documents released by the court, the first two bellwether trials will be held in the Eastern District of Louisiana and will be heard on February 6th and March 13th of 2017, after this, the remaining two bellwether trials are scheduled to be heard on April 24th and May 30th of 2017.
Xarelto has been named in a surging number of lawsuits which synonymously allege that those taking the anticoagulant are at increased risk for dangerous, uncontrollable bleeding episodes. In the current complaints, Xarelto has been linked to gastrointestinal bleeding, strokes, blood clots, and brain hemorrhages. Plaintiffs state that manufacturers Bayer Healthcare AG and Janssen Pharmaceuticals, (a division of Johnson & Johnson), failed to properly warn the public about the significant risks associated with their drug.
The quickly approaching bellwether trials regarding the Xarelto MDL are expected to provide plaintiffs and their attorneys with a better idea of how juries might respond to certain testimony and evidence as future trials progress. It was ordered by the judge that plaintiffs and defendants select 40 cases for a bellwether pool by January 11, 2016. Now that this has been accomplished, 4 trial-ready cases will be chosen from those 40 to be heard in 2017 bellwether trials.
Attorney Joseph Osborne understands that there are likely many other individuals out there who have suffered adverse health effects after using Xarelto, but who have not yet become involved in the current Xarelto MDL. He believes that there is still time for these people to join the cases awaiting trial, and is currently working to help ensure that these individuals will also be able to fully explore their legal rights as well. They may be entitled to significant compensation. To help facilitate this, Attorney Osborne is currently offering free consultations to those who have been affected.
