Power Morcellator Lawsuit Alleges Tool Exposed, Disseminated, And Upstaged Uterine Cancer
January 12, 2016 – – Banville Law reports on the details of a lawsuit filed against manufacturer Gyrus Acmi LP in reference to their laparoscopic power morcellator device. The complaint is in good company with many others which have also been filed against several power morcellator manufacturers. Filed lawsuits share similar allegations claiming that when power morcellator tools are used for gynecological surgeries such as hysterectomies and myomectomies on uterine fibroids, they can potentially expose and disseminate previously undiscovered cancer cells, significantly impacting the chance of survival for the patient.
In this specific lawsuit, the plaintiff alleges that the morcellator device which was used for her laparoscopic gynecological surgery exposed and spread cancer cells which were previously encapsulated within her uterine fibroid. She states that the shredding and whipping motion of the blades on the tool spread the cells throughout her body. After the surgery, she was suddenly diagnosed with an aggressive and widespread cancer, which, today, is threatening her life.
This woman is joined by many other women across the nation, some of which have even passed away after filing suit from aggressive, fatal cancers. Lawsuits like this have continued to appear at an alarming rate, prompting the U.S. Food and Drug Administration to announce a new set of warnings regarding laparoscopic power morcellation during gynecological surgeries in 2014.
The FDA’s safety warning indicated that women should refrain from undergoing hysterectomies or myomectomies involving laparoscopic power morcellation, due to the significant risk that it could spread and accelerate cancer cells. Additionally, they estimated that 1 out of every 350 women who are currently undergoing these procedures may have uterine cancer that they are completely unaware of.
Morcellator lawsuits continue to be filed today, and those filed against morcellator manufacturer Ethicon (a subsidiary of Johnson & Johnson) have been consolidated by the U.S. JPML to form multidistrict litigation number 2652 in the U.S. District of Kansas. They are being presided over by the Honorable Judge Kathryn H. Vratil.
