Sexual Assault Attorney Files Another Suit Against West Chester Pennsylvania Massage Envy

January 12, 2016 – – AbuseGuardian.com reports on yet another lawsuit filed on September 14, 2015 in the Court of Common Pleas Philadelphia County, which names Massage Envy as one of the defendants. The sexual abuse allegations are again alleged to have taken place at the West Chester, Pennsylvania Massage Envy location naming James Deiter as the perpetrator and filed under case number 150800409.

The Plaintiff attended a massage appointment in January of 2015 where she met Deiter, the Massage Envy therapist, in the lobby of the West Chester spa. She followed him to the massage room and undressed to her comfort level, leaving her underwear on. During her massage Deiter allegedly touched her bare breasts and genital area. The Plaintiff reported this assault to a female staff member at Massage Envy. The court documents state that the West Chester location contacted the main Massage Envy headquarters in Arizona, but never contacted the Pennsylvania Board of Massage Therapy or law enforcement, rather they decided to handle it “in-house.” Deiter was suspended for one week from his job, and allowed to return without any restrictions regarding the female clients. The complaint states: ”Massage Envy West Chester unfathomably recommended Deiter to unknowing female customers after they knew he had already sexually assaulted at least one client at that location.” Due to the alleged negligence on the part of the defendant it is believed that multiple other female clients were sexually assaulted at Massage Envy.

The Plaintiff suffered and continues to suffer from emotional distress, shock, pain of mind and body, loss of enjoyment of life, and much more. The court documents state: “ . . .as a result of being sexually assaulted by Deiter as she now feels a tremendous amount of mental anguish, grief and guilt as a result of the women who were assaulted after she reported her assault to Massage Envy West Chester.”
