FDA Safety Release Discusses Concern Over Power Morcellator Use And Uterine Cancer

January 13, 2016 – – Banville Law reports that as the lawsuits consolidated in MDL No. 2652 move forward, the United States Food and Drug Administration recently issued another safety notification discussing certain medical devices, including the power morcellator. They informed the public that they were changing policies to allow public notification of safety issues with medical devices to be announced earlier. Any devices that are being studied and evaluated for new safety concerns by the FDA will be reported right away in the future, in hopes to save lives.

This decision comes just as power morcellators fall under intense scrutiny across the nation, and members of congress have requested a full investigation into the tools, which many allege can expose and spread dangerous and fatal cancer cells when used during gynecological surgeries. Power morcellator manufacturers across the U.S. are facing these cancer-related product lawsuits. Lawsuits which have been consolidated in the MDL have all been filed against Ethicon, a division of the well-known Johnson & Johnson corporation.

The new FDA release was made public just before the new year, on December 31st of 2015. The draft guidance was entitled, “Public Notification of Emerging Postmarket Medical Device Signals (‘Emerging Signals’).” Throughout the proposal, the FDA details what “emerging signals” mean to them, and discusses the aggressive and proactive changes in policy.

The Ethicon brand power morcellator lawsuits continue to grow in number today. They are being overseen by Judge Kathryn H. Vratil in the U.S. District of Kansas. As the attorneys at Banville Law note the steady increase in lawsuits, they are working to ensure that women who have not yet filed, but may have the right to, will be able to explore their legal rights. To encourage justice for these women, Banville Law is currently offering free morcellator consultations. Those who have undergone laparoscopic power morcellation and who were given a cancer diagnosis post-surgery may be entitled to legal action and significant compensation.
