A Look At FDA Communications Amid IVC Filter Lawsuits

The FDA issued statements about the devices in 2014 after newly developed research was available. The FDA suggests that implanting physicians and clinicians responsible for the ongoing care of patients with retrievable IVC filters consider removing the filter as soon as protection from pulmonary embolism is no longer needed.
The devices are typically used in patients who are unable to take anticoagulant drugs. They are a small cage-like device used to catch blood clots before they can travel to other areas of the body such as the lungs. Reports of adverse events involving the devices have included perforation of the IVC, device migration, embolization (movement of the entire filter or fracture fragments to the heart or lungs), filter fracture, and difficulty removing the device, according to the FDA.
A number of patients who have claimed to suffer from such complications have filed legal claims against manufacturers for poor design, manufacturing and failing to warn of risks. Lawsuits against Bard were first filed in 2012 in California and Pennsylvania state courts and were combined into a Multidistrict Litigation (MDL) Panel in the U.S. District Court of Arizona in 2015. Those cases against Cook Medical have been combined into an MDL in the Southern District of Indiana.
