An Overview Of IVC Filter Complications That Have Led To Lawsuit Filings

The FDA announced in 2010 that they had received 921 reports involving IVC filters. Complications have involved several different problems such as device migration, detachment of device components, perforation of the IVC and filter fracture. Of the 921 reports, the most common was device migration. These complications, according to the FDA, are believed to be related to the retrievable devices not being taken out for long periods of time, past the time when the risk of pulmonary embolism has subsided.
The complications have since prompted many patients to file lawsuits against manufacturers for poor design, manufacturing and failing to warn of risks. Lawsuits against Bard were first filed in 2012 in California and Pennsylvania state courts and were combined into a Multidistrict Litigation (MDL) Panel in the U.S. District Court of Arizona in 2015. Those cases against Cook Medical have been combined to an MDL in the Southern District of Indiana.
The devices are usually used in patients who are undergoing surgery for injuries such as those sustained in car accidents, serious falls, and gunshot or stab wounds. Patients receiving treatment with IVC filters are usually at a risk for serious blood clots but are unable to take anticoagulant drugs. The devices are designed to catch the blood clots before they are able to travel to other areas of the body, such as the lungs.
