Arizona Home to Toughest DUI Laws in the Country

Arizona has the toughest DUI laws in the country. Do you know your rights?

Multiple studies show that Arizona is home to the toughest DUI laws in the country. Because it is a zero tolerance state, an officer can arrest someone even if their blood alcohol level is below the legal limit of 0.08.

Even a first offense can have very serious consequences, which is why it is imperative to hire an experienced DUI lawyer if you are stopped and arrested on suspicion of DUI.

Brian Sloan is an award-winning DUI lawyer, headquartered out of Phoenix, and is the founder of The Arizona DUI Team. He says calling a lawyer should be the first order of businesses for anyone charged with driving under the influence.

“Arizona’s DUI laws give police officers unlimited discretion when it comes to arresting someone on suspicion of driving under the influence,” Sloan says. “The best way to protect yourself is to exercise your right to remain silent and contact an attorney as soon as possible.”

Someone charged with a first-time DUI offense could face one day in jail, up to six months in jail, thousands of dollars in fines and fees, and could have their driver’s license suspended or revoked for months or years. Even after the suspension period, those convicted of DUI will almost always have to place an ignition interlock device on any vehicle they operate for one year or more.

Charges get more serious depending on the results of a blood alcohol test. For instance, someone with a BAC of 0.15 can be charged with Extreme DUI, and blowing higher than 0.20 could result in what attorneys refer to as a Super Extreme DUI charge.

A second DUI offense, with a prior DUI within seven years, raises the stakes even higher with longer jail sentences, heavier fines and fees, and a mandatory one-year driver’s license revocation.
