As Case Numbers Grow, Xarelto Lawsuit Plaintiffs Allege Manufacturer Negligence

September 28, 2016 – – TheProductLawyers.com reports on the U.S. Food and Drug Administration’s (FDA) approval of Xarelto, a new-generation blood-thinning drug. Since the original approval of the drug onto the market for use by patients, the FDA has issued two black box warnings related to Xarelto. It is commonly known that such action could mean that the agency is about to ban a product from the market completely.

In addition to the FDA’s action, there have been thousands of lawsuits filed in which plaintiffs have uniformly claimed that the drug has placed them and other users at an increased risk for spontaneous and dangerous episodes of uncontrollable bleeding, as well as other potentially severe side effects. All of the lawsuits have been filed against the makers of the drug, Janssen Pharmaceuticals, a division of corporate giant Johnson and Johnson, and Bayer AG, which produces the drug overseas as well as in the United States.

Since there are so many commonalities in the cases, actions have been taken to consolidate them. In a decree made by the U.S. Judicial Panel on Multidistrict Litigation (JPML), in excess of 2,800 cases have been grouped together in a multidistrict litigation (MDL) in a court in the Eastern District of Louisiana, and has been assigned number 2592. The other is a mass tort program in which the Court of Common Pleas has consolidated 550 cases in Philadelphia, PA. Since the cases in Philadelphia are still in their pretrial and discovery phases, there is a potential for this number to actually increase further. The plaintiffs in all these cases agree on one thing – that Janssen and Bayer AG were negligent and reckless in their release of Xarelto to the market, and the companies did not make the public aware of the dangerous risks involved with taking the blood-thinning drug.
