Rand Spear – Avoid a Semi-truck Accident This Thanksgiving

The week of Thanksgiving is one of the biggest travel weeks of the year. It’s the kickoff to the holiday season, and people use this time to visit friends and family all over the country.

Unfortunately, the boost in traffic also means a sharp increase in car and truck accidents. After all, semi-truck drivers have to continue delivering their freight regardless of how many extra cars on are the road. For them, driving is a full-time job. If you plan to travel this Turkey Day, here are several things you can do to make sure you reach your destination safely, according to the American Red Cross.

Wear your seat belt. It’s true: Seat belts save lives. The Centers for Disease Control and Prevention (CDC) points out that wearing your seat belt is the single most important thing you can do to lower your risk of being killed in a car or truck accident.
Don’t drive drowsy. The CDC estimates that up to 6,000 fatal vehicle accidents each year are caused by drowsy drivers. Of course, turkey and the consumption of large meals are associated with sleepiness. If you plan on tucking into a large dinner at Thanksgiving, consider tucking into bed before you hop in the car.
Be cautious in work zones. Road work is inevitable if you plan on driving on the highway for a long road trip. If you encounter road construction, slow down and take your time.
Don’t speed. Speed limits are there for a reason. Excessive speed is the leading cause of traffic accidents. Staying safe is more important than shaving a few minutes off of your drive.
Don’t tailgate. Keep plenty of distance between your car and the vehicles in front of you—especially semi-trucks. Semis must often stop without much warning, which can make you crash into the trailer. Because these trailers are so much taller than the average vehicle, rear-end semi-truck collisions are usually catastrophic.
Pack an emergency kit. It’s a good idea to keep an emergency kit in your vehicle, especially if you plan to drive in snowy or icy weather. In bad storms, emergency workers are frequently overwhelmed with calls, and they may not be able to reach you right away. Having some supplies handy can help you stay safe and comfortable while you wait. Your kit should include bottled water, nonperishable food, batteries, a flashlight, flares, a blanket, and any spare medication you may need.

Georgia Truck Accident News – Do Semis Get Recalled Like Regular Cars?

The last few years have been record-setting years for vehicle recalls. Most notably, the Takata airbag recall has affected over 100 million vehicles. If you have ever received a postcard in the mail, notifying you that your vehicle has been recalled, you may have wondered if semi-trucks are ever subject to similar recalls.

The answer is yes. Furthermore, because semi-trucks are required to undergo regular inspections, their owners must follow through on these recall notices. A failure to take the semi-truck in for repair or retrofitting can result in fines and even the issuance of a shutdown order from the Federal Motor Carrier Safety Administration (FMCSA).

FMCSA Issues Safety Bulletin for Volvo Trucks

The FMCSA can also issue safety bulletins ordering semi-truck owners and carrier companies to place recalled trucks out-of-service until they have been repaired. The agency did just that in March 2016, following a recall of Volvo trucks manufactured between 2015 and 2016. In that recall, a missing roll pin had the potential to allow the lower steering shaft to disconnect from the junction block, causing a total loss of steering.

Other Types of Semi Recalls

Fully loaded, semi-trucks can weigh up to 80,000 pounds. It’s easy to understand why the FMCSA takes recalls seriously when it comes to these giant vehicles.

Although a semi-truck recall can be burdensome for truck operators and carriers—who depend on a functional fleet to earn a living—these trucks are massive machines with thousands of moving parts. Even a slight defect can cause a catastrophic accident. Safety is a priority—even if it means taking a truck off the road for a day or two while a defective part is replaced.

In some cases, the National Highway Traffic Safety Administration (NHTSA) issues recalls. In other situations, the companies that manufacture parts for semis notify the NHTSA of a problem and issue their own voluntary recall. This type of recall occurred over the summer of 2016, when a truck part company voluntarily recalled 195,000 defective spring brake valves.

For regular vehicle owners, recalls are voluntary. You may not be required to take in your car for repair, but it’s incredibly important to do so. Although recalls can be an inconvenience, taking care of a potentially dangerous defect helps you stay as safe as possible on the road. You can check to see if your car has been recalled by visiting safercar.gov and entering your car’s VIN or make and model information.

Michelangelo’s Sistine Chapel: The Exhibition Features The Last Judgment

Michelangelo’s frescoes at the Sistine Chapel are considered a masterpiece without precedent, most famously featuring The Last Judgment, executed on the altar wall. Jail Time for Texting & Driving Says Philadelphia Car Accident Lawyer Rand Spear

Daniel Gallatin was a father, grandfather, veteran and fireman for nearly 40 years when he was killed in 2013 when his motorcycle was struck by a driver who was texting while driving in Hickory Township in Lawrence County in western Pennsylvania. Those who cared about him took action and helped pass Daniel’s Law which was signed by Governor Wolf earlier this month. This new state law imposes jail time for texting while driving in some situations. Philadelphia car accident lawyer Rand Spear says drivers are needlessly distracting themselves with cell phones and causing serious injuries and deaths.

Under the new law drivers distracted by their cell phones could be sentenced up to five years in prison if a motor vehicle accident results in a fatality. If texting while driving causes serious bodily injury it could result in a two year sentence. Under past law the highest fine for texting while driving, a primary offense in Pennsylvania, was $50. The driver who killed Gallatin served sixty days in jail, seven months of work release and house arrest on manslaughter charges, according to the Philly Voice.

More than 14,800 crashes were caused by drivers distracted by cell phones in 2015 in Pennsylvania, resulting in 66 deaths, according to the National Highway Traffic Safety Administration. Nationwide distracted driving contributed to the deaths of 3,328 people in 2012 and about 421,000 people were injured in accidents involving distracted drivers.

William Van Camp was distracted by texting while driving in Bucks County in 2011 when his Volkswagen collided with a pickup truck, causing severe injuries to the two men inside. As part of his criminal sentence he needs to speak to young drivers about the dangers of texting while driving, according to NBC10.

Anthony Arminio and his father were in the truck. Arminio suffered broken legs, a broken pelvis, a broken hip and bleeding to his brain because of the accident. His father’s neck was broken. After three years the two have gotten more than $400,000 in medical treatment but both are still in pain due to their injuries.

Van Camp sent or received 13 text messages in the 12 minutes leading up to the accident. He admits to texting to three different people while behind the wheel. Van Camp can’t remember what he was texting about or who he was texting with at the time of the accident but he’s not forgetting the consequences. He spent nine months in prison, had to complete fifty hours of community service and pay restitution.

Police Databases May Have Your Image

As reported by NPR, around 50 percent of Americans’ faces are on file in police databases around the country—regardless of whether they have ever been suspected of a crime. In some cases, police can even run searches of faces in real-time video surveillance footage.

How do the police obtain these images? Driver’s licenses, according to the co-author of the Georgetown Law Center report. He explained that an individual’s fingerprints are unlikely to end up in a police database unless the person has been arrested or charged with a crime. But in 26 states, simply going to the DMV and getting a driver’s license means your face automatically gets included in a criminal database. He went on to say that these systems have little transparency and no audits. Furthermore, the DMV is not required to disclose that it is turning your image over to the police or federal law enforcement agencies

Databases Yield Inaccurate Results

In an FBI study, the FBI ran sample tests in its own database and discovered that one out of every seven searches turned up between two and 50 innocent faces. The study also revealed that facial recognition software tends to make more mistakes in young faces, female faces, and African-American faces. Experts say the software’s algorithms are less accurate with darker skin tones, faces with makeup, and smoother faces—which means people in these demographics have a higher chance of being wrongfully identified as a suspect in a criminal case.

Texas is one of 26 states that cooperates with the FBI by submitting driver’s license photos to nationwide law enforcement databases.
