Bellwether Trial Selection Continues As Xarelto Lawsuit Filings Increase

June 29, 2016 – – TheProductLawyers.com announces progress in the more than 3,000 cases against the new-generation anticoagulant Xarelto. Late in 2015, the U.S. Judicial Panel on Multidistrict Litigation issued their response to a petition for agglomeration. They created a multidistrict litigation (MDL) 2592 in order to expedite the trial process and conserve resources both public and private. They also stated that any subsequent cases with similar allegations brought before federal courts would be joined with the MDL. The mass litigation will ultimately be tried in the Eastern District of Louisiana.

Plaintiffs represented in MDL 2592 allege that taking Xarelto as prescribed substantially increased their risk of suffering a catastrophic bleeding event. This is an event in which bleeding cannot be stopped except through extreme measures. Allegations are made against the defendants,the manufacturers of the anticoagulant, Bayer AG and Janssen Pharmaceuticals (a division of Johnson & Johnson Corporation.)

On December 17th, Judge Eldon Fallon, who was appointed by the JPML, issued a court order. From those represented in the MDL, lawyers for both the plaintiffs and the defendants must each select ten court cases that were most trial-ready from the states of Mississippi, Louisiana, and eight others with the most concentrated claims. These would be merged with twenty lawsuits meeting the same criteria selected by the court.

Judge Fallon explained that this created a trial pool of forty cases, from which only four would then be selected for bellwether trials. Bellwether proceedings will allow lawyers for both the plaintiffs and the defendants to present evidence before a jury panel, observe their reactions, and tailor future proceedings based on gathered data. This is yet another measure to ensure that resources are wisely spent for both parties in the lawsuit.

The original selections for the pool were completed no later than January 11th of this year, which means that the plaintiffs in the MDL are one step nearer to the scheduled bellwether trial court dates. While the bellwether trials will take time, plaintiffs are confident that additional lawsuits will continue to be added to the MDL.
