When asked to comment, King said, “Most couples going through a divorce assume that they will have to battle out their child custody arrangements and financial issues in the courtroom. However, full-blown divorce trials can often be avoided through mediation. This can save folks enormous amounts of time, aggravation, expense and uncertainty of outcome.”

Mediation is a process by which divorcing spouses, their attorneys and a neutral mediator meet in an effort to reach compromise about financial and child custody issues. Typically, the meeting is held at the office of the mediator, with each party and his/her attorney in separate conference rooms. Each side usually submits a confidential statement to the mediator prior to the meeting, outlining their view of the case and what they think necessary to settle it. The entire proceeding is confidential, and none of the participants, including the mediator, can be required to testify in court about what transpired during the mediation.

“Some of the most important issues that are dealt with during these mediation meetings include the division of marital assets and debts, alimony, child custody and child support. Mediators guide these sessions and help come up with compromises that both parties can live with in order to settle their divorce,” King said.

According to King, in Tennessee, the best mediators are those who are specially trained and certified to perform that function. “Fortunately, there are many experienced family law attorneys who serve as mediators, and you definitely want to pick someone who not only knows the law, but who also has familiarity and direct experience with the judge who will be deciding your case.”

King was also quick to add that, by statute in Tennessee, parties must attempt mediation before going to trial, and judges are prepared to appoint a mediator if the parties cannot agree on whom they want to mediate their case.

When asked to elaborate further, King said, “There’s no doubt that dissolving a marriage is stressful, even in the best of circumstances, which can often lead people to make irrational decisions based on emotions, and to even disregard good advice from their attorneys. Sometimes, they have to hear it from someone else, and a mediator, who has no dog in the fight and can be completely objective, can serve that function more effectively.”

King added that many clients who once thought their spouse was impossible to compromise with are often surprised at the effectiveness of mediation. “I’ve often walked into mediation with a client who thought their spouse would never agree to a settlement, only to walk out with a client who was very pleasantly surprised.”
