California Woman Awarded $65 Million In Damages In Talcum Powder Lawsuit

According to Express, the 62-year-old plaintiff used J&J’s baby powder for feminine hygiene for more than forty years, until her diagnosis three years ago. The news source states that after having undergone surgery, radiation, and chemotherapy, the woman has an 80 percent chance of dying in the next two years. After three hours of deliberation, the jury determined that the plaintiff was to be paid $65 million in punitive damages.
Many women have claimed that they have gotten the life-threatening disease after using Johnson & Johnson’s talcum powder products.The first talcum powder lawsuit was filed in 2009 by a woman from Sioux Falls, South Dakota. She was diagnosed with ovarian cancer in 2006 when she was 49 years old, according to an article by Huffington Post. She had allegedly used Johnson & Johnson powder for feminine hygiene purposes for many years.The plaintiff filed the complaint claiming Johnson & Johnson should be held accountable for gross negligence and fraud. Though a jury confirmed the association between cancer and talcum powder, the plaintiff was offered no compensatory damages.
Thousands of plaintiffs have filed suits so far concerning the alleged effects of these powders. Many have already been awarded millions of dollars in compensation and lawsuit numbers are continuing to grow. Most of the filed cases are pending in a Missouri federal court, while others have been filed in New Jersey, where Johnson & Johnson is headquartered.
