Coloplast Increases Legal Budget Amid Transvaginal Mesh Lawsuit Filings
April 06, 2016 – – TheProductLawyers.com reports on Coloplast’s increased legal budget as lawsuit filings concerning transvaginal mesh continue to increase. A September NASDAQ report indicates that the company increased their litigation budget by $448 million so that it could cover settlements and legal costs.
Coloplast is not the only company to be met with lawsuits. Other manufacturers of the device including Johnson & Johnson, C.R. Bard and Boston Scientific are also facing lawsuits claiming that the devices cause serious adverse side effects and that the companies knew about the defects and still pushed it to market. Women who have used the devices claim that they have complications including bleeding, organ perforation, erosion of mesh through the vagina, infection, severe pelvic or vaginal pain, inability to engage in sex, vaginal scarring, vaginal shrinkage, recurrent incontinence or prolapse and neuromuscular problems. Several plaintiffs have been awarded millions in settlements after filing lawsuits claiming the devices that allegedly caused these issues have significantly altered their quality of life.
The devices were originally used in the ‘50s for abdominal hernias and were later approved by the FDA in 1996 for use in stress urinary incontinence procedures. They were then approved in 2002 for treatment of pelvic organ prolapse, a condition in which the pelvic organs sag and need to be supported. The mesh is usually made from non-absorbable synthetic polypropylene, which plaintiffs have alleged breaks apart inside the body causing other issues.
While thousands of cases have been filed against mesh manufacturers for alleged life-altering side effects, many more are anticipated to be added to the list.
