Construction Accident Lawyer Obtains $43 Million Verdict For Worker

June 01, 2016 – – LipsigLawyers.com has announced that one of their partners recently took his client’s case to trial and was able to obtain a successful verdict which awarded $43 million in compensation to the plaintiff.

At trial, the plaintiff talked about his accident which has left him in a wheelchair for the rest of his life. He had attended a friend’s party in an apartment building in Brooklyn and a group decided to go up to the roof to enjoy the night views. While he was on the roof, he indicated to the party host that he needed to use the restroom. Since there was no restroom on the roof, the host suggested that he use an empty Gatorade bottle in a more private part of the building. He agreed and began to walk to the section which the host indicated was a bit more secluded. In the darkness, he was unable to see a gap between apartment buildings. He stepped right into that gap and fell nearly 70 feet to the ground below.

He survived the fall but his spine suffered irreversible damage and left him paralyzed.

Mr. Alan Shapey of Lipsig, Shapey, Manus, & Moverman, P.C. represented the plaintiff in his personal injury case which was filed against the building developer who built the apartment building. During the trial, Mr. Shapey referenced a 1968 law which requires all rooftops which may be used for entertainment to have a ten-foot high fence around the edge. At the time of the accident, there was no fence in place.

The jury awarded the plaintiff $2.7 million for past damages and $41 million for future expenses that are expected.
