When asked for a comment, Shakhnevich said, “Anyone who stands to be accused of a felony should take certain steps to mitigate the potential fallout in a case. Here are some things to keep in mind.”

One of the most important things that people must keep in mind is staying silent when dealing with law enforcement.

“The crux of the matter is that you don’t want to bind yourself to a story. Over time, the development of a criminal case will lead to the exposure of evidence. As a defendant, you don’t know what that evidence will be, so while you may know what the act is, you don’t know what the evidence will be, such as video evidence or witnesses,” he commented.

Another reason not to speak to law enforcement is that it’s perfectly legal for them to lie and say that they have evidence they might not have.

When asked to elaborate, Shakhnevich said, “Generally speaking, this is why there’s never a benefit in speaking with the police. The purpose of police speaking to you is generally not a good one, even if you’re not the target of the investigation. When police talk to you, it’s not good, no matter what, so staying silent is the best option,” he said.

Finding a good attorney is a must for anyone who has fallen into legal trouble in terms of a felony accusation, according to Shakhnevich.

“The great thing is that you’re given a free lawyer at your arraignment in New York. So even if you don’t anticipate the arrest coming and you can’t hire a lawyer in advance, you’re given a free lawyer who will represent you at the arraignment,” he said.

Following this, Shakhnevich alluded to the fact that anyone in this situation should then engage in finding and interviewing a right lawyer.

“Once that arraignment process is over, the next step is to find a lawyer who is experienced in your particular case in your court, which will make the process a bit more smooth and seamless,” he said.

It’s also important to meet certain requirements to mitigate the fallout from collateral issues of an arrest or charge, such as opportunities in finding housing or employment.

“In my cases, collateral issues are critically important. Let’s say that you have a person who is gainfully employed or attending school but who might have done something wrong without a criminal history. With my clients, in particular, this is relevant for doctors, lawyers, and teachers who are licensed or employed by the state whose jobs are affected,” he said.

“So, for instance, if you’re a lawyer, you may have to mandatorily report your arrest, and if you don’t, that leads to further discipline. In other words, not following these mandatory requirements could be worse than the direct consequences of an arrest.”

Another important thing to keep in mind is arranging for bail if necessary in a case.

“The bail determination is something that needs to be addressed right away. If, at arraignment, bail isn’t paid in a very short period of time – minutes to hours – then you could be sent to await your trial, which is a dangerous proposition,” he said.

When asked how someone should approach a judge, he said, “If it’s a case where bail is likely to be set, then you definitely want a family member or friend to bring in as much money as possible. Or you may want to arrange for a bail bondsmen who can secure your appearance in court.”
