Dallas auto accident attorney Amy Witherite notes that the victim of a car crash may make post-accident treatment mistakes that unfavorably impact the value of the victim’s claim. Here are some ways a car crash victim may inadvertently lower the claim’s value:

1. Stopping treatment too soon. Going to treatment can be logistically difficult, especially when a car accident victim is juggling other broken details. But, stopping treatment prematurely is a huge mistake. Not only does this impact the victim’s ability to fully recover as quickly as possible, but it sends a signal to the opposing party that the injury was minor.

1. Being deceptive about past medical history. A victim may believe that the victim best positions himself or herself to receive compensation if the victim attributes all the health concerns to the accident. But, the opposing party will likely get ahold of the victim’s previous medical records. And, if the victim was deceptive about an old back injury, the opposing party will use this information to its advantage.

1. Trumping up the severity of an injury. An accident victim who denies that treatment has helped the injury or who continues to complain long past the point at which the victim felt pain does himself or herself no favors. In fact, many doctors note such deceit in patient charts.

Bottom line: An accident victim should always continue with the full course of treatment recommended by the physician and should always be honest about past medical history and symptoms.
