When asked to comment, Whitten said, “As a family-focused law firm, the first thing we discuss with our clients is that divorce should be seen as the last resort. It’s important to make sure a couple has exhausted all their options before beginning divorce proceedings.”
Whitten added that the best way to determine if a couple is prepared for divorce is by asking his clients a series of questions.
“An important starting point for us is to see if both parties have clearly communicated their concerns and expectations about their relationship with each other. Often, it could be a case where one person is unaware of a certain problem in the relationship,” he said.
This is important, according to Whitten, as a couple might want to take a step back to reassess if the problem can be fixed to save the marriage.
“If the marriage can’t be saved, then at least both parties can feel more at ease that they cannot resolve their problems, which will ultimately lead to a more amicable split,” he said.
Whitten added that other challenges of divorce can be overwhelming, particularly when children are involved.
“We also like to ask anyone who comes to us if they have considered how a separation and divorce process might affect their children. Often, couples going through a divorce use their children as cannon fodder, which is always detrimental,” he said.
“However, sometimes divorce is inevitable. A smooth divorce process, which can be achieved through a collaborative divorce, can mitigate negative effects on their children,” he added.
The divorce process can also take a toll financially.
“Couples who have shared financial resources and obligations for years on end should consider the details of how filing for divorce will affect them. Many of the couples who we see are unaware of the financial consequences,” he said.
He added that the best way to navigate separating finances is by consulting a financial advisor or lawyer to reflect on how much getting a divorce will cost, as well as what the financial reality will be post-divorce.
