Fatal I-90 Chicago Tollway Beam Collapse Triggers Response From Construction Accident Lawyer

June 07, 2016 – – LipsigLawyers.com’s Thomas Moverman provided comments on the increased need for safety precautions by urging OSHA to focus on safer working conditions for construction workers to help minimize future fatalities. Moverman also sends his condolences to the family of the fallen construction worker and hopes that with further safety regulations the frequency of these incidents can decrease significantly.

According to a report from The Chicago Tribune, on April 5th, a 45-ton beam fell at a construction site in Des Plaines which left 1 man dead. 3 other workers were injured in the accident and were taken to local hospitals for treatment. The crew members were on a job to remove a beam under the Jane Addams Memorial Tollway on Interstate 90. The fallen victim had worked in the construction industry in Chicago for over 20 years and was regarded as a hard worker according to the secretary-treasurer of Laborers Local 225, a local labor union.

In a news release issued shortly after the accident, the Occupational Safety and Health Administration (OSHA) stated that the incident was preventable through adherence to OSHA regulations and precautions. Moreover, OSHA has opened an investigation into Omega Demolition Corporation which was the employer of the victim, as well as Judlau Contracting Inc. which was the general contractor responsible for the site.

As detailed by The Chicago Tribune’s report, in the past ten years OSHA has issued 9 citations to Omega Demolition. Initial reports from the incident concluded that a strap or chain supporting the beam failed, however, OSHA officials along with local authorities are investigating whether there were enough support straps and chains to support such a heavy beam.

While the cause of this incident is still unclear, with further regulations and increased inspections, the frequency of future incidents of this nature should decrease monumentally. Since OSHA inspectors are currently held responsible for the safety and health of over 59,000 workers each, significant reforms must be implemented to adequately to combat this on-going problem.
