First Bellwether Trial For Xarelto Lawsuit Filings Delayed Until March

October 13, 2016 – – TheProductLawyers.com reports on the delayed start of the first bellwether trial for Xarelto cases that has been ordered by presiding judge Eldon E. Fallon.

The first bellwether trials in Xarelto cases, which were originally scheduled for February 2017 have been delayed until March because of the NBA All-Star game in New Orleans. Two cases will serve as test trials for over 7,000 cases that claim Bayer AG and Johnson & Johnson should be held responsible for adverse events reported by patients using Xarelto.

Plaintiffs in the cases allege that the drug causes adverse side effects including internal bleeding, gastrointestinal bleeding, brain hemorrhaging, epidural hematoma, pulmonary embolism, heart attack, and stroke. Plaintiffs further allege that the companies did not adequately warn consumers about the risk of taking the drug and that, as a result, they have suffered serious health problems and sometimes even death. Those cases against the manufacturers have been consolidated into MDL No. 2592, a multidistrict litigation panel created to more efficiently deal with the number of federally-filed cases. A mass tort program has also been established in Pennsylvania to better manage the 620 cases that have been filed in the Commonwealth of Pennsylvania thus far.

The drug was introduced in 2011 for prevention of blood clots and deep vein thrombosis in patients undergoing knee and hip replacements, atrial fibrillation and for general use in reducing the occurrence of blood clots, and stent thrombosis in patients with acute coronary syndrome.
