Indiana Judge Thwarts Cook Medical’s Attempt To Bar FDA Reports In Lawsuit Regarding IVC Filter

In May, an Indiana judge denied Cook Medical’s request to bar plaintiffs from seeking information about the manufacturer’s alleged failure to report adverse events related to the filters to the FDA. The judge denied Cook’s request explaining that the evidence may be relevant to the claims. These cases in the MDL for the Southern District of Indiana, claim that the company knowingly marketed defective devices. They further allege that those same devices cause serious side effects that can significantly alter a patient’s quality of life.

IVC filters, which were first introduced in the ‘70s, are designed to catch blood clots before they travel to the lungs. They are usually inserted in patients who have recently suffered serious trauma and are at risk of pulmonary embolism. They are generally given to those patients who are unable to take anticoagulants. The FDA has stated that between 2005 and 2010, it had received 921 adverse event reports related to the devices. These events included issues such as device migration, filter fracture, embolizations, and perforation.

Since then, hundreds of lawsuits have been filed against manufacturers such as C.R. Bard and Cook Medical, seeking compensation for health issues that have allegedly resulted from use of the device. Plaintiffs are arguing that these companies should be held responsible for allegedly marketing a device they knew was defective.
