IVC Filter Lawsuit Defendant Cook Medical Asks For More Time To Prepare For Settlement Negotiations

April 25, 2016 – – TheProductLawyers.com reports on recent details of the consolidation of all Cook IVC filter lawsuits which were federally-filed. The lawsuits were consolidated to a single court by the JPML to form an MDL and are being overseen in the Southern District of Indiana. Since the MDL was initially created in 2014 defendants and plaintiffs alike have been preparing for the initial cases to be heard at trial starting in September of 2016.

Details showed that a settlement conference had been scheduled for March of 2016. At this settlement conference, plaintiffs and defendants would be able to negotiate potential settlement options in the presence of a U.S. magistrate judge. This conference had been scheduled for February but was then pushed back and rescheduled for March 22nd through 24th.

It was reported recently, however, that it did not take place in March, and that defendant Cook Medical requested that the court postpone the conference for another 60 days to provide them with additional time to prepare and research details of current IVC filter lawsuits. This motion was said to have been submitted on February 9, 2016. Reports noted further that the defendant’s counsel had requested additional time to research details noted in the pending Cook IVC filter lawsuits, and to review the latest information regarding the medical devices, and discuss all findings with their client.

At this time, there are reportedly more than 250 lawsuits pending in the MDL. Those anxiously awaiting the settlement conference are hopeful that it will help facilitate negotiations that can be considered successful between the plaintiffs and defendants, and that a resolution may be possible to attain without trial. If this is not possible, trials will move forward as planned, and will begin with early bellwether trials.

Plaintiffs who have filed Cook IVC filter related lawsuits commonly claim that the medical devices are defectively designed and manufactured by the defendant. IVC filters are surgically implanted into patients’ inferior vena cava, which is a large vein that helps to transport blood from the lower legs toward the heart and lungs. When the cage-like device is implanted, it works much like a filter to catch and hold potential blood clots until they dissipate, preventing them from traveling into the heart or lungs and causing medical problems such pulmonary embolism. The filter is meant to be used in patients temporarily, and to be removed as soon as their risk for blood clots subsides. Patients who are deemed at heightened risk for the development of blood clots, but who are unable to take traditional blood-thinning drugs are those most commonly advised to use IVC filter devices.

Patients filing lawsuits against the products’ manufacturer, however, claim that Cook IVC filters have traveled from their original insertion points. Some allege that when the device moved, it broke apart, and pieces of it punctured veins or became lodged within internal organs and intestines. Patients have noted that they required hospitalization to deal with these adverse events. Others state that the IVC filter devices remain still inside of their bodies where they may continue to cause damage, as surgeons were unable to safely remove them due to the high-risk areas they traveled to.
