IVC Filter Lawsuit Filings Increase, As Researchers Investigate Potentially Life-Threatening Side Effects

July 18, 2016 – – TheProductLawyers.com outlines the common allegations that IVC filter lawsuit plaintiffs have claimed in their suits against the manufacturers of various brands of filters. Deep vein thrombosis (DVT) is a condition that occurs when a blood clot forms within a deep vein, leading to an increased risk of pulmonary embolism, and post- thrombotic syndrome. Some of the most common symptoms of DVT are increased swelling, tenderness, discoloration of the skin, along with pain and fatigue.

IVC filters are meant to prevent inferior vena cava thrombosis, which is the formation of a clot in the IVC, the largest vein in the body, that in turn limits deoxygenated blood from reaching vital organs such as the heart and lungs. IVC filters are cage-like devices that were made to minimize the risk of blood clots, however, patients have continued to claim that the devices have adverse side effects. Radiologists at Massachusetts General Hospital concluded in a study they conducted that 3.7 % of IVC filter patients being monitored died of pulmonary embolism, providing some factual evidence for current plaintiffs.

In recent years hundreds of patients have filed lawsuits against IVC filter manufacturers, in most cases naming C.R. Bard and Cook Medical as defendants. Plaintiffs generally claim that the two companies were negligent in releasing the devices which they claim were aware of the defective design of the devices yet marketed them anyway. Additionally, plaintiffs allege that the manufacturers failed to warn users of the potential risks associated with the devices and marketed them as safe to future potential users.

Moreover, 2 Multidistrict Litigations (MDL) have been consolidated against device manufacturers Cook Medical and C.R. Bard, one in the Southern District of Indiana (No. 2570), and another at the U.S. District Court of Arizona (No. 2641). Both MDLs are in the process of developing bellwether cases, in an attempt to expedite the process of justice.
