Lawsuit Filed Against the NYPD In Relation to Brooklyn Woman’s Stairwell Death

NEW YORK, New York (January 10, 2018) – Gersowitz Libo & Korek, P.C., one of New York’s leading personal injury firms, was hired by the family of Tonie Wells to investigate and file suit against the New York Police Department for its failure to take sufficient action in possibly preventing her stairwell death.
According to WABC News, Tonie Wells, 22, was found dead just before 10 a.m. on December 27, 2017 at the bottom of the basement of the home she shared with her husband and her toddler daughter on Sterling Place in the Crown Heights section. NYPD officials said she suffered trauma to her body, specifically bruising on her neck. This is what led detectives to believe she was either pushed or fell down the flight of stairs.
According to the New York Daily News, police sources say her husband of just nine months, Barry Wells, shoved her down the stairs before leaving the home. He left her toddler daughter with the dead body. The source further states that NYPD brass are looking into the possibility that officers did not check on Wells after being alerted to the child’s cries earlier.
The Daily News reports that the NYPD has suspended two cops for failing to respond to a 911 call from Tonie Wells’ home an hour before she was found dead. The officers, identified as Wing Hong Lau and Wael Jaber, both 11-year veterans, responded to the scene but apparently never got out of their car to check the home.
Tonie Wells’ family has hired Gersowitz Libo & Korek, P.C. to pursue legal action against the NYPD for failing to properly investigate and possibly avoid the fatal tragedy.

According to the Daily News, Internal Affairs is investigating the incident. The source further reports that Brooklyn Borough President Eric Adams even said the initial police response by the two officers was unacceptable.
“We expect a full investigation into this senseless tragedy that has taken the life of this young mother,” said Korek. “Right now, the focus is on providing comfort and support to this innocent child who lost her mom.”
