Many die without leaving a will, or the wording is vague and open to interpretation which then invites legal challenges and can take years to conclude at a cost of millions of dollars. Brumfield said: “If anything, the mistakes made by celebrities in estate planning should be salutary lessons for the ordinary man and woman in the street.”

However, a recent survey from USLegalWills.com hints otherwise. Half of the people aged 65 and over have a will that is not current, and, shockingly, more than 60 percent of American citizens don’t have a will. 

He added: “Estate planning is essential as it protects the individual’s wealth and clarifies who should receive their assets. They can be complex if trusts are utilized, but at least relatives will not be left confused and uncertain. Additionally, the probate process could take months if not years to complete if a person does not leave a will.”

He pointed to a number of blunders by celebrities that people draw on and consider estate planning a priority today and not leave it to chance.

Sonny Bono, one-half of Sonny and Cher, died without making a will. Dying intestate left his estate open to legal challenges, including a $1.6 million demand from his second wife, Cher, for unpaid alimony.

Prince also died intestate, and his $200 million estate remains unresolved mainly because the IRS and the executor have yet to agree on the estate’s value. Apparently, legal fees are close to topping $50 million.

Actor Heath Ledger, who died in 2008, failed to update his will, and his daughter was left out of the estate. Fortunately, Ledger’s parents and sisters reportedly gifted their shares of his estate to his daughter. The wills of Michael Jackson, Marlon Brando and James Brown are others that have drawn legal fire.

Brumfield said: “Rather than join the list of celebrities that have failed to ensure a cast-iron estate plan, seek advice from a professional attorney in their field. They can discuss strategies, the advantages of trusts and the best options for them in planning.

He further advised that failure to adopt trusts could leave an estate to estate taxes, probate can be lengthy, and their assets could end up in the wrong hands. 

Equally, failing to update an estate plan can inadvertently leave children from previous relationships with nothing and a new partner with everything. When Jim Morrison of The Doors died, he stipulated his girlfriend received everything. When she died three years later, the estate passed to her parents.

Brumfield said: “These examples show that having a will, a trust or a comprehensive estate plan can help minimize taxes and reduce the risk of legal challenges.”

Once created, an estate plan needs to be updated on a regular basis to reflect changing times, fortunes and families. 

He concluded: “Taking these lessons in life can help you succeed where celebrities have failed. Creating an estate plan now is better than leaving everything to chance and the prospect of your assets being assigned in ways you never thought possible.”
