Fantini, said a 100-day window was the target for his legal team to assess, evaluate and decide on whether to take a hernia mesh legal claim further.
On an episode of 5 Minute Legal Insights Podcast, he walked through what a client would face when they first picked up a phone to speak to a client relation specialist.
“That first point of contact with the Hernia Mesh Compensation Program will see our in-house specialist ask questions to learn the full story. They are specifically trained, have years of experience, and know our case criteria very well,” he advised, noting the initial call typically takes no more than 15 minutes.
From there, a client will be assigned a dedicated case manager and a paralegal whose tasks are to check back in with the client relating to the doctors, addresses, and dates, and ensure the paperwork is all in order.
He added: “Our trained paralegal staff will obtain all the medical records and will work with our medical teams. This helps with evaluating the initial surgery, what product was implanted, and to assess any additional surgeries or treatments. These records provide a picture of what the client faced.
“One of the things that we wanted when we set up the Hernia Mesh Compensation Program was to make sure medical records don’t simply pile up on someone’s desk. We are proactive when the records land on our desks, and we have designed a workflow that helps get the case dealt with promptly.”
The records are assessed by experts and summarized before being handed on to Fantini who personally reviews each case. “I go over the findings, and we often find that the second or third operative reports shows the mesh was torn or crumpled, or causing problems to the organs.
“We can then point to this summary when we go to a jury, and say “Here’s the evidence from the doctor that proves our case.”
He revealed that he had worked through “tens of thousands” of cases to assess whether they were a viable case or not. “There are over 30,000 cases in litigation, and we estimate tens of thousands more, maybe up to 100,000 individual cases to come.
“The timeline from first call to case assessment and advising the client whether we are pursuing a case is usually completed within 100 days.”
Fantini explained the Program was established to educate the public these hernia mesh products are dangerous and they can work with leading attorneys and experts to get the best resolution possible.
He added: “The Program allows the client to focus on their recovery while our team shoulder the stress of pursuing a lawsuit and move cases forward efficiently.”
