Speak only when advised to do so. Your communications with your lawyer are protected by the attorney-client privilege, but that privilege is waived if others hear your communications. Sometimes parties hold a “joint session” in which the mediator and all parties meet as a group. You will probably be asked to remain silent at this time and anytime the mediator is in the room. If you have questions or comments, wait until you are alone before you speak candidly to your attorney.

Listen carefully. Pay close attention to what the mediator and your lawyer say.

Ask questions. Lawyers and mediators may appear to be speaking a different language. Do not hesitate to ask questions or request a more thorough explanation.

Make sure you understand any proposed settlement. You will need to know the compensation you will receive, the compensation your lawyer will receive, and other important terms regarding the consequences of the settlement.
