Misconduct Claims Become Part Of Transvaginal Mesh Lawsuit Proceedings
April 25, 2016 – – TheProductLawyers.com reports on alleged misconduct that was reported during the transvaginal mesh litigation. According to Bloomberg, Johnson & Johnson claimed last year that women had received phone calls from strangers who knew their personal medical information and solicited them to file fraudulent lawsuits so they could collect settlements.
These allegations are one example of many hitches in the complicated MDL’s that have been formed across the U.S. to address claims that pharmaceutical companies marketed defective transvaginal mesh that caused severe complications. Companies including C.R. Bard, Johnson & Johnson, Cook Medical, Boston Scientific and Coloplast Corp have all been affected by the lawsuits that have now numbered over 70,000.
Women in these suits have claimed that after receiving the mesh implant, the have suffered injuries including organ perforation, bleeding, infection, inability to engage in sexual intercourse, severe vaginal or pelvic pain, vaginal scarring, erosion of mesh through the vagina, fistulas, recurrent incontinence or prolapse, need for correctional surgery, vaginal shrinkage, urinary tract infections and neuromuscular problems. Spouses of some of the plaintiffs have even included loss of consortium in some of their claims.
The mesh is usually made of synthetic polypropylene and is used to support bulging organs in cases of pelvic organ prolapse (POP) and to support the urethra in cases of stress urinary incontinence (SUI). Transvaginal mesh was approved first for stress urinary incontinence procedures in 1996 and later for POP in 2002. Since then, the FDA has received thousands of adverse events reports and has switched the classification of the device from “moderate risk” to “high risk.” They have also amended several warnings for the devices and called for careful evaluation of its use by healthcare professionals.
