MoloLamken Releases 2018 Supreme Court Business Briefing

(Washington, July 3, 2018) – The national litigation boutique MoloLamken LLP is pleased to announce the release of this year’s MoloLamken Supreme Court Business Briefing. This is the eighth year the firm has published its summary of the decisions from the U.S. Supreme Court’s past Term that have the greatest relevance to business.

“After two years of largely modest decisions, the Supreme Court was back in full force, delivering major rulings in the business arena and elsewhere,” noted MoloLamken partner Robert Kry. “While the Court strived to reach a middle ground in a few cases, by and large it showed little hesitation about handing down broad rulings with far-reaching impact,” added Michael Pattillo, another firm partner.

The Court addressed many significant issues this Term. In a case with major implications for e-commerce, the Court held that States may require out-of-state retailers to collect tax on sales to state residents, even if they have no physical presence in the State. The Court also extended its long line of pro-arbitration cases to the employment context.

The Court decided a pair of cases concerning class action litigation, one favoring business by imposing new limits on the time to file, and the second favoring plaintiffs by allowing them to bring class actions under the federal securities laws in state courts. And in a major patent case, the Court upheld the constitutionality of inter partes review, an administrative mechanism for reconsidering issued patents.
