A single-vehicle motorcycle crash that occurred at approximately 7 p.m. on the night of Tuesday, July 18th has left one dead and one severely injured.

47-year-old Marci L. Luiso of Port St. Lucie was transported to Holmes Regional Medical Center following the accident where she was pronounced dead shortly after arrival. She was the passenger on the bike at the time of the accident.
The driver of the motorcycle was also transported to the same facility where he remains under treatment in the Intensive Care Unit at the time of this writing. According to hospital spokesmen, he is expected to recover but they declined to comment on his condition beyond this point due to the accident still being under investigation by The Traffic Homicide Investigators from the Melbourne Police Department Selective Traffic Enforcement Unit.

While the reason the accident warranted further investigation by the police was not commented on, Sgt. Brian Hart of the Melbourne Police Department did have comments to make. “We don’t believe any helmets were worn at the time of the crash,” Hart said via email. “First responders did not observe any, nor were any located on scene.”
It should be noted that under Florida’s current helmet law, both of the victims were over the age of majority and not required by law to wear helmets.

Florida Statute 316.211 (b) states, “a person over 21 years of age may operate or ride upon a motorcycle without wearing protective headgear securely fastened upon his or her head if such person is covered by an insurance policy providing for at least $10,000 in medical benefits for injuries incurred as a result of a crash while operating or riding on a motorcycle.” So, the lack of protective headgear is not in itself cause for the investigation.

When local attorney and motorcycle enthusiast Brad Sinclair was queried about the events following the Brevard County motorcycle accident he stated:
“There is nothing really unusual about an investigation of this type following a fatal crash. I am not privy to the facts of the case, but it seems that there were no other vehicles involved and no eyewitnesses have come forward. When someone dies in the State of Florida, whether in an auto accident or at home asleep in their bed, and the circumstances surrounding their death are unclear, an investigation is pretty much automatic and shouldn’t be taken as a sign of any wrongdoing.”

Note: Measure “HB 6009” is currently being considered by the Florida House of Representatives. This bill would amend the current statutes and do away with the age exemption allowed in Florida’s present helmet law.
