Multiple Plaintiffs in Bleeding Lawsuits Against Xarelto Successfully Combine Voices in Multi-District Litigation

September 01, 2016 – – Under the supervision of Hon. U.S. District Judge Eldon E. Fallon, Xarelto bleeding lawsuits filed nationwide in federal courts will be consolidated under multidistrict litigation, according to BloodThinnerHelp.com. The more than 2,800 cases include very similar allegations revolving around uncontrollable bleeding after taking the drug Xarelto. In 2015 the U.S. Judicial Panel on Multidistrict Litigation (MDL) decided that the similarity of allegations warranted consolidation. Combining these plaintiffs’ claims would save litigation time and money, they alleged. By circumventing discovery issues and pre-trial judges’ conflicting rulings, the courts will save time and money.

Due to the outsize amount of cases revolving around similar allegations of uncontrollable bleeding after using Xarelto, the Judicial Panel decided on December 4, 2015 to move the cases to MDL under the leadership of Judge Eldon Fallon. According to the MDL, this plan would unburden those litigating separately, and would be adequately advised under Judge Fallon, whose expertise in multi-district litigation should help direct the proceedings smoothly.

It took the work of a group of plaintiffs three months prior to move the cases toward consolidation. In October 2015, these plaintiffs requested oversight by the Southern District of Illinois. However, the defendants, Bayer AG and Janssen Pharmaceuticals (a division of Johnson and Johnson Corporation), resisted litigation relocation, as they are based in New Jersey.

People suffering from excessive bleeding after taking Xarelto will likely join the litigation, since the advent of the MDL will likely encourage more patients suffering from these side effects to step forward as plaintiffs. Since its initiation, the MDL’s case-load has increased, and as these cases await trial, more plaintiffs are expected to join the litigation process.
