New Zofran Birth Defect Lawsuit Claims Drug Caused Cleft Lip

August 18, 2015 – – Zofranlegal.com reported that a family in Arkansas has officially filed a lawsuit against GlaxoSmithKline alleging that the mother’s use of Zofran, to help ease her pregnancy related nausea, directly resulted in her child being born with a birth defect.

Months have passed since the first Zofran lawsuit was filed in Massachusetts, in February 2015, and nearly every week new complaints have been submitted alleging that the use of Zofran during pregnancy has caused a variety of birth defects. Zofran, which was first used to treat nausea related to chemotherapy and anesthesia, was never approved by the FDA for use in pregnant women.

On May 21st, 2015, attorneys for the Arkansas family filed a lawsuit against GlaxoSmithKilne, alleging that the mothers use of Zofran during her pregnancy as an anti-nausea medication caused her son to be born with a partial cleft lip. The complaint claims that GlaxoSmithKline falsely advertised the drug Zofran as being safe for use in pregnant women. The complaint stated that the US Justice Department filed charges against GlaxoSmithKline regarding their promotion of the off label use of Zofran for pregnancy related nausea. Additionally she claims that, had she been aware of the increased risk of birth defects, she never would have taken Zofran.

The child in question was born on June 1st, 2012 and was diagnosed with a partial cleft lip. A cleft lip occurs when the skin of the upper lip fails to fuse together, and as a result there is an opening in the upper lip which, if severe, can extend into the nose. The lawsuit alleges that three months after the child was born, he had corrective surgery performed on his lip which resulted in a permanent scar, and an unsymmetrical lip. The complaint also claims that his birth defect resulted in speech delays and the need to receive further treatment by a speech therapist.

At this time, there have been around 33 total lawsuits filed against GlaxoSmithKline, all alleging that the drug Zofran caused birth defects. The birth defects noted in those lawsuits have included cleft lip, cleft palate, cardiac defects, and kidney defects.
