Plaintiff Files IVC Filter Lawsuit Against Cook Medical Claiming Chronic Pain
June 30, 2016 – – TheProductLawyers.com reports on a lawsuit filed recently by a plaintiff claiming her IVC filter causes her chronic pain. The Kentucky woman claims in her suit (Case no. 5:16-cv-00066-GNS ) that she had been hospitalized for Deep Vein Thrombosis in her right leg in February 2013. There she received a Cook Celect Vena Cava Filter. She was again admitted to the hospital in July 2015 with chronic back and abdomen pain. An angiogram revealed that she developed a new clot and that her filter had titled, causing deep vein thrombosis in her left leg. The plaintiff had another IVC filter implanted above the Cook filter and had right and left vein catheter placements. She will now have to continue on anticoagulants, the suit said.
Her case is similar to many others that have already been filed. Many patients who have experienced severe side effects as a result of IVC filter placement have opted to file lawsuits against manufacturers such as Cook Medical, C.R. Bard, and Boston Scientific. The lawsuits have been combined in MDLs in Arizona and Indiana and are in the process of developing bellwether cases. These suits allege that in addition to the devices causing severe side effects, the companies were aware of the defective design and continued to push the product to market. Many patients have claimed to have suffered from the effects of filter fracture, embolizations, filter migration, and perforation. The FDA stated that 921 adverse events related to filters were reported between 2005 and 2010.
