Plaintiffs In Xarelto Lawsuit Allege Bayer and Janssen Ignored FDA Letter About Misleading Advertisements

June 11, 2016 – – TheProductLawyers.com reports on the number of cases filed across the country related to dangerous potential side effects of Xarelto, manufactured by Janssen Pharmaceuticals and Bayer AG, the former of which is a subsidiary of corporate giant Johnson and Johnson. The number of lawsuits to date is in excess of 3,000 with 2,800 of them being part of a multidistrict litigation (MDL 2592) in Louisiana. There are an additional 550 cases in Philadelphia, PA as part of a mass tort program. All of the lawsuits filed name Janssen and Bayer as defendants with similar allegations related to excessive bleeding resulting from taking Xarelto.

One of the more notable lawsuits involves a group of 10 people who have had relatives that allegedly died because of excessive bleeding side effects of the drug. The 10 plaintiffs live in different states and have filed a wrongful death lawsuit in St. Clair County Circuit Court on November 20, 2015, under case number 15-L-670.

The plaintiffs, in this case, have levied 9 counts of misconduct on the part of Janssen and Bayer ranging from fraud to wrongful death in that they falsely marketed the drug and neglected to let the public know about the drug’s possible side effects. They are seeking compensatory damages from the defendants for each of the deceased family members in the amount of $50,000. This amount is to help cover medical bills, funeral expenses and for pain and suffering for those left behind who must fill the void in their lives left by their deceased loved ones.

Plaintiffs are also alleging in their court documents that the U.S. Food and Drug Administration (FDA) notified the defendants by letter that the marketing claims being made about Xarelto were misleading and did not sufficiently identify the risks involved in taking the medication. However, Bayer and Janssen did not heed or respond to the FDA’s letter as their marketing strategy remained the same.
