Plaintiffs Suggest That Power Morcellation Can Free And Spread Deadly Uterine Cancer Cells
January 15, 2016 – – Banville Law reports on allegations within power morcellation lawsuits, which suggest that the device helps to spread hidden cancers in patients undergoing laparoscopic gynecological surgeries, such as hysterectomies and myomectomies. These lawsuit filings have caused warranted public concern over the procedure and its link to widespread, aggressive cancer, including fatal leiomyosarcoma.
Concern about these issues continues to mount as lawsuits continue to appear, alleging that the tool has, in fact, spread cancer cells throughout plaintiffs’ bodies, creating a high-grade cancer that is difficult to treat which impairs the overall life expectancy of these women. The risks that the procedure poses certainly appear to be severe, causing an FDA safety announcement and attention from members of congress, who have requested an investigation regarding Ethicon (Johnson & Johnson) and the power morcellator tool that they manufactured.
In a recent case, as is occurring more and more frequently, the plaintiff was admitted to the hospital to undergo a hysterectomy and bilateral salpingectomy. Physicians chose to use a power morcellator to perform this uterine fibroid surgery, as it offered a minimally invasive option which offers the patient a faster recovery time.
The patient, now a power morcellator lawsuit plaintiff, underwent these procedures via laparoscopic power morcellation. Prior to the surgery, she was deemed cancer free, and took much comfort in this fact, as anyone would. Post-surgery, however, the patient was quickly diagnosed with a stage-4 cancer which had seemingly spread from a uterine fibroid to her breasts and bones. When encapsulated within a fibroid, these cancer cells can prove virtually impossible to detect, however the plaintiff argues that the spinning blades of the power morcellator exposed and then spread these cells, creating the severe health problems she must now face, and leaving her to fight for survival.
This particular lawsuit has been filed against Karl Storz Endovision, Inc., as their brand of morcellator was used for the procedure. It was filed in the U.S. District Court for the Eastern Division of Michigan under case number 2:15-cv-10352-TGB-APP. Power morcellator lawsuits have been filed against various brands of morcellators across the nation. Those filed against Ethicon have been consolidated to form multidistrict litigation by the JPML.
