Power Morcellator Lawsuit Alleges Device Caused Spread Of Cancer And Death

November 12, 2015 – – Tracey & Fox reports on another lawsuit filed against a power morcellator device and manufacturer Ethicon, (a subdivision of Johnson & Johnson). This suit was filed by the family of a woman who has now passed away, according to the family, due to the use of a power morcellator during her laparoscopic surgery.

The woman underwent a gynecological surgery to remove painful uterine fibroids in December of 2012. Physicians used a laparoscopic power morcellator to complete this surgery. The tool was inserted into her abdomen through a small incision, where blades on the device spun to slice and shred uterine fibroid tissue.

Unfortunately, while doing this, the family alleges that the device exposed and disseminated previously undetected cancer cells throughout the woman’s body. The cells could not be detected beforehand due to the fact that they were encapsulated in her fibroid. The family indicates that the spreading of this cancerous tissue caused a rapid upstaging of her uterine cancer, and the woman’s diagnosis quickly went from treatable to deadly. In fact, the family indicates, the woman died less than 2 years later due to metastatic uterine cancer.

The United States Food and Drug Administration stepped up to release new warnings regarding power morcellators after several studies and lawsuits connected the device to the spreading of cancer. They indicated that approximately 1 in every 350 women undergoing hysterectomy or myomectomy procedures with a morcellator actually have hidden uterine cancer, and that the morcellators could spread these cancerous tissues, specifically uterine sarcomas, beyond the uterine area.

Across the United States, lawsuits continue to add up regarding power morcellators from various manufacturers claiming similar things. The suits have now been consolidated to form MDL number 2652. It is fully expected that as these cases await trial, more will be filed.
