Power Morcellator Lawsuit Claims Device Spread Cancer Cells Through Abdomen
October 29, 2015 – – Tracey & Fox reports on another lawsuit filed against a Laparoscopic Power Morcellator manufacturer in Philadelphia. In this particular case, the co-plaintiff alleges that use of a power morcellator spread previously undetected cancer cells throughout her abdominal area.
Used for many years now, power morcellation has been a welcomed alternative to more invasive, open gynecological surgeries, saving patients from larger incisions, longer recovery time, and higher medical bills. The power morcellators enable surgeons to perform necessary medical procedures through substantially smaller abdominal incisions.
Power morcellators are inserted into the abdomen where they tear up any tissue causing doctor’s concern, sometimes just uterine fibroids, and sometimes parts of the uterus or surrounding areas. The problem is, as research is now indicating, during this procedure, the morcellator can also tear up previously undetected cancerous cells, and spreads them throughout the area. Patients who have undergone the procedure and have since filed suit allege that the morcellator spread their undetected cancer in this way, and therefore significantly worsened their diagnosis.
In this particular suit, plaintiffs, a husband and wife, were recommended power morcellation to remove what were thought to be benign tumors in the wife during a gynecological surgery. Instead, according to the couple, the procedure spread cancer cells throughout her body. An immediate concern among patients who have experienced similar outcomes is their long-term survival.
The couple’s complaint stated: “The PKS PlasmaSORD Bipolar Morcellator disseminated and seeded cancer throughout plaintiff’s abdominal cavity, thereby causing and accelerating the metastases and spread of her cancer, worsening the long-term prognosis and the natural course of her cancer.”
“The spread of the life-threatening cancer suffered by the plaintiff was a direct result of the use of the PKS PlasmaSORD Bipolar Morcellator during her 2011 surgical procedure.” The brand of morcellator specifically mentioned is marketed and manufactured by Gyrus Acmi LP.
In the suit, the couple also references medical journal studies from as early as the 1990s, which appear to report a risk of spreading cancer when using the device. They allege that Olympus (which Gyrus Acmi LP is a subsidiary of,) either knew or should have known that the power morcellator devices they were selling could potentially cause cancerous tissue pieces to be spread throughout the body.
Across the United States, similar lawsuits against manufacturers of power morcellators continue to appear. Individuals who developed aggressive or widespread cancer after undergoing a power morcellator procedure may be entitled to compensation.
