Power Morcellator Lawsuit Plaintiffs React To Insurance Company Product Coverage Removal

November 13, 2015 – – Tracey & Fox reports on a move by insurance company Aetna to cease coverage for hysterectomies and myomectomies involving a power morcellator tool. This decision comes after many lawsuits have been filed against the device, and after a U.S. Food and Drug Administration announcement appears to link power morcellation use to a potential for exposing and spreading hidden uterine sarcomas.

Insurance provider, Aetna, the United States’ third largest health provider, has stated that they will no longer cover power morcellator use during gynecological surgeries involving uterine fibroids. The company noted that at this point, they will require physicians to obtain special clearance in order to use the device in other procedures which they may insure and cover.

Power morcellator devices from various manufacturers have been the subject of over 1,700 federal law suits at this point. A recent FDA issued safety communication regarding the tool also warned that most women should not have a gynecological procedure done involving a power morcellator, due to several studies and adverse events noted that said the tool could spread cancer during hysterectomies (which remove uterine tissue), myomectomies (which remove uterine fibroids), oophorectomies (which remove ovarian tissue), and salpingectomies (which remove fallopian tube tissue).

The FDA went on to note that statistics show that an estimated 1 in every 350 women who undergo one of these gynecological surgeries may have undiagnosed uterine sarcoma which the morcellator can disseminate during the surgery. It was additionally noted that around 1 in every 500 women have undiagnosed leiomyosarcomas, which is a more aggressive form of uterine cancer.

The mounting lawsuits were formed into multidistrict litigation number 2652 to enable efficient, smooth litigation. The formation of an MDL helps to avoid differing judge rulings, and duplicate discovery, and helps to conserve resources of everyone involved. It is expected that as the cases in the MDL await trial, additional suits will be filed.
