Power Morcellator Uterine Cancer Lawsuits Spur U.S. Lawmaker To Request FDA Criminal Investigation Of Deaths

January 12, 2016 – – Banville Law reports that United States Representative Mike Fitzpatrick has requested that the U.S. Food and Drug Administration launch a criminal investigation into the death of certain individuals which have been linked to gynecological surgeries on uterine fibroids with laparoscopic power morcellation. He asked that deaths, which occurred at Massachusetts and New York hospitals, be investigated. U.S. Power morcellator tools made by various manufacturers have been the subject of an increasing number of lawsuits which commonly allege that the device can expose and disseminate uterine cancer cells, creating a high-grade, accelerated, and sometimes fatal cancer in patients.

In a letter written to the FDA’s Office of Criminal Investigations on December 18th, Representative Fitzpatrick asked the agency to look into reported deaths at Boston’s Brigham & Women’s Hospital, The University of Rochester Medical Center, and Rochester General Hospital. Each death he requested to be evaluated further involved a gynecological surgery with a laparoscopic power morcellator device. In his letter, the representative pointed out that FDA rules require the reporting of any incidents where medical devices may have contributed to or caused the death of a patient.

In 2014 the FDA issued a safety warning against laparoscopic power morcellation, indicating that women should refrain from undergoing these procedures during hysterectomies or myomectomies involving uterine fibroids due to a cancer spreading risk which could impact their life expectancy. They indicated, as well, that an estimated 1 in every 350 women who currently undergo the procedure may have uterine cancer cells that they are completely unaware of.

Fitzpatrick is hoping that his letter helps to save the lives of women across the nation. It is not the first letter he has written regarding power morcellation. In August of 2015, he was among 12 members of congress who together wrote a letter asking the Government Accountability Office to investigate the devices more closely. It has been reported that the GAO agreed to look into things as per their request, although additional information on this research has not yet been released.
