Progress In MDL Comprised Of Xarelto Lawsuit Cases

June 25, 2016 – – TheProductLawyers.com announces developments in the growth of recent cases brought against Bayer AG and Janssen Pharmaceuticals, a division of Johnson & Johnson, related to the drug Xarelto. In recent months, the numbers have surpassed 3,000 separate suits, many of which allege similar harm as a result of taking the anticoagulant.

In order to expedite the process, the U.S. Judicial Panel on Multidistrict Litigation merged 2,800 of these cases into multidistrict litigation (MDL) suit No. 2592, to be overseen in the Eastern District of Louisiana. In Philadelphia, the Court of Common Pleas has consolidated suits into a mass tort program, which comprises an additional 550 cases. Due to the highly publicized nature of the existing complaints against the drug companies, suits continue to be filed by those who claim similar harm while taking the drug.

Xarelto is known as a new-generation anticoagulant, which the FDA approved for use in 2011. Due to its function in preventing the formation of blood clots, it was initially proposed as an ideal medication for those recovering from hip or knee replacement surgery and patients who were at risk of pulmonary embolism or had deep vein thrombosis. Later, it was also approved for use in patients with atrial fibrillation, a cardiac condition that elevates the risk for stroke.

Both the mass tort program in Philadelphia and MDL No. 2592 claim that they were put at increased risk for catastrophic bleeding events without proper warnings by the aforementioned drug companies. The claim extends to the failure of the manufacturers to warn physicians prescribing the drug and overseeing treatment of patients.

As the plaintiffs await their day in court, many of them are reassured by similarities of their complaints to those made against another anticoagulant, Pradaxa. The public protests against Pradaxa culminated in several thousand lawsuits, which were eventually settled without a trial.
