In addition to the money that must be returned to the consumers, Machol & Johannes has to forgive fees and costs they charged to consumers that could total $250,000, as well as pay the attorney general’s office $414,000 to cover costs related to its investigation.

While there are federal agencies and federal laws in place to protect consumers from debt collectors, states have the ability to regulate debt collection however they see fit.

In addition, some debt collection practices aren’t subjected to the federal Fair Debt Collection Practices Act, and therefore aren’t regulated under the Consumer Financial Protection Bureau.
