Ryan Garry Reveals How Much a Lawyer Will Cost for an Assault Charge in MN

Ryan Garry explains, “Federal assault is generally governed by 18 U.S.C. Section 113. The sentence depends on the facts. Assault with intent to commit murder, for example, carries a sentence of up to 20 years. Assault by wounding another carries a sentence of a fine and/or up to 6 months in prison.”

There are actually five degrees of assault and these are governed by the Minnesota Statutes 609.221, 609.222, 609.223, 609.2231, and 609.224, respectively. First degree assault is of two kinds. The first one is assault inflicting great bodily harm and is punishable by a maximum of 20 years of imprisonment and/or a fine of up to $30,000. The other type is assault with deadly force against a police officer or correctional worker. This is also punishable by up to 20 years in prison and/or a fine of up to $30,000.

Meanwhile, the experienced criminal attorneys go on to explain that a second degree assault happens when a dangerous weapon is used. It is punishable up to seven years of imprisonment and/or a fine of up to $14,000. But if there is substantial bodily harm that resulted from the assault, the punishment can be up to 10 years of imprisonment and/or a fine of up to $20,000.

Third degree assault is of three kinds but all are punishable by imprisonment of up to five years and/or a fine of up to $10,000. The first kind is if there is substantial bodily harm. The second type of third degree assault is done against a minor (child abuse) and the offender has a history of abusing the minor. The third type is done against a child under the age of four and results in bodily harm.

Fourth degree assault has several possibilities. For the most part, this crime has to do with assaults against public officials, like reserve officers, postal service employees, firefighters, school officials, DNR employees, and police officers. It is punishable by imprisonment of up to three years and/or a fine of up to $6,000. The offense level can be a felony or a gross misdemeanor.

Fifth degree assault can be a felony, gross misdemeanor, or simple misdemeanor. The misdemeanor level occurs when a person intentionally causes another person to fear immediate bodily harm or death or when a person intentionally tries or causes bodily harm to another person. The gross misdemeanor level is a misdemeanor assault that is done against the same victim within 10 years as domestic violence offenses. The felony level occurs as a misdemeanor assault against the same victim within 10 years of two or more as domestic violence offenses. Fifth degree assault also covers assault using a firearm.
