Sexual Assault Attorney Files Complaint Against California-Based Massage Envy
January 11, 2016 – – AbuseGuardian.com reports on a lawsuit filed against a California Massage Envy spa claiming sexual assault and attempted rape of a female client. The suit was filed on June 6, 2011 in the Superior Court of California, Orange County. The alleged assault in case 30-2011 is said to have occurred in a Massage Envy located in Laguna Beach on May 8, 2011.
The Plaintiff, a resident of California, arrived for a one hour massage, and was greeted by the perpetrator and therapist Mark Peregil Valenzon, an employee of Massage Envy. During the course of the massage the plaintiff alleges that Valenzon sexually assaulted her and made an attempt to rape her. During this time the plaintiff screamed repeatedly that Valenzon should leave, yet he did not leave, and no staff member came to her aid. When the plaintiff fled the room, she went up to the front desk in the lobby, and tried to explain that she had almost been raped. The court documents say that she requested that the staff call 911, but they ignored her.The plaintiff has to leave the premises, and call 911 herself so that police could come to investigate.
If these allegations are true it would seem that this location has directly violated their own policies since the Massage Envy website states that they have a “Zero Tolerance and Code of Conduct Policy” which “sets forth clear standards for appropriate conduct of therapists and estheticians.” Valenzon was arrested for his crime, but this lawsuit is naming the defendant as Massage Envy claiming that they were negligent on a number of counts as well as responsible for assault and battery, violation of right to privacy and more.
The complaint describes the injuries suffered by the plaintiff as severe anxiety, fear of being left alone, physical illness, inability to sleep, inability to perform at work or school, and difficulty carrying out daily tasks.
