South Dakota Plaintiff Files IVC Filter Lawsuit Alleging Device Has Embedded Into Internal Organs

April 07, 2016 – – TheProductLawyers.com reports on another lawsuit filed against Bard in reference to their Eclipse IVC filter device. The plaintiff filing is a woman from South Dakota who filed her lawsuit on January 12, 2016, in the U.S. District Court for the Southern District of South Dakota. Because all federally-filed Bard IVC lawsuits have been consolidated in the District of Arizona, it is expected that this lawsuit will soon be transferred there.

Details of the lawsuit show that the plaintiff claims that she suffered serious injuries after being implanted with a faulty Bard Eclipse IVC filter. She is requesting more than $75,000 in compensation. She states that the device was implanted in her on October 12th, 2012 at the Sanford University of South Dakota Medical Center in Sioux Falls, South Dakota. The IVC filter was implanted to block potential blood clots from traveling to the heart and lungs, and was intended to be removed when the blood clot risk dissipated.

IVC filter devices are implanted into the inferior vena cava, which is the body’s largest vein. The vein transports blood from the legs to the heart and lungs. The plaintiff, in this case, notes that after using the device for about one and a half years, she went to the medical center to undergo treatment again. During this appointment, they discovered that her IVC filter had traveled from its implantation spot, and had become embedded into her internal organs.

The plaintiff states that physicians attempted to remove the filter but were unsuccessful, as its new location posed too great a risk. Because of this, the plaintiff notes that the device remains in her body today, and claims that she continues to suffer injuries due to it, as well as anxiety and psychological trauma, as she never knows if it will move again, puncture something, or cause more damage.
