Statute of Limitations For A Transvaginal Mesh Lawsuit Differs Among States

April 20, 2016 – – TheProductLawyers.com reports on the differing time periods for statutes of limitations involving injury lawsuits. According to Nolo.com, the statute of limitations on a case involving injury can range anywhere from one to six years in the United States, depending on the state. The website states that in places such as Louisiana, plaintiffs have only one year from the time of injury to file a suit. In other states such as Maine and North Dakota, those plaintiffs have up to six years from the time of injury.

The differing of the statutes is part of the reason that many advocates of women’s health are urging women to come forward as soon as possible if they believe they have suffered injuries from using transvaginal mesh. The mesh, usually made of synthetic polypropylene, has been used to treat stress urinary incontinence and pelvic organ prolapse after it was approved in 1996 and 2002 for those purposes. Since receiving over 1,000 reports of adverse events in 2008, the FDA has issued several warnings about the devices and reclassified them as “high risk.”

Many of the women filing lawsuits against the device manufacturers such as Johnson & Johnson, Coloplast Corp, Cook Medical, Boston Scientific and C.R. Bard, have claimed that the devices have caused numerous side effects that have significantly altered their quality of life. Those symptoms include bleeding, organ perforation, inability to engage in sexual intercourse, severe pelvic or vaginal pain, infection, vaginal scarring, vaginal shrinkage, fistulas, urinary tract infections and neuromuscular problems.

Several thousand cases concerning mesh have already been brought to court and more are expected to accumulate.
