Suppression of Twin Peaks Video by Dallas Criminal Defense Lawyer Clint Broden

Dallas, TX — Submit Press Release 123 – On June 22, 2015, the District Clerk for McLennan County issued a subpoena for production of the video taken by the Waco Twin Peaks restaurant on May 17, 2015. The subpoena was issued at the request of F. Clinton Broden of the Dallas based criminal defense firm Broden, Mickelsen, Helms & Snipes LLP. Broden requested the video to prepare for a probable cause hearing set for his client Matthew Alan Clendennen.

The subpoena was served on Patrick Keating, an attorney with Haynes & Boone in Dallas and the attorney for the Waco Twin Peaks franchisee. Mr. Keating had previously agreed to accept service of the subpoena on behalf of his client and to produce the video in compliance with the subpoena by 9:00 am on June 26, 2015. It is important to note that this video is the sole property of the Waco Twin Peaks franchisee and does not belong to the City of Waco, the Waco Police nor McLennan County.

The City of Waco moved to quash this subpoena this afternoon. Nevertheless well accepted rule of law is that the only party that can move to quash a subpoena is the party to whom the subpoena is issued, in this case the Waco Twin Peaks franchisee. Mr. Keating indicated that the Waco Twin Peaks franchisee did not object to producing the video in compliance with the subpoena.

“It is troubling that the City of Waco would go to such lengths to suppress this video,” said Broden. “The Waco Police have repeatedly given the public contradictory information about the events at Twin Peaks and have said that the video will support its current version of the facts, yet they have now taken this extraordinary measure to interfere with the subpoena process,” he added.

Broden noted that the City of Waco has not only sought to suppress the video but that the Waco Police also seized the cell phones of many non-bikers who were present at or around Twin Peaks on that day. “Think of the many police incidents in the last six months and imagine if the police had been able just to seize the citizen cell phone videos in those cases,” observed Broden. Broden said he had been contacted by Melissa Karin (who is represented by Waco attorney Hamilton Lindley) who had her cell phone and purse seized by police on May 17 and then had to crawl through the window of her house upon returning home because her purse contained her house keys.

“The video will show what the video shows, so why can’t the public see it? In the United States we encourage transparency over secrecy and the public has a right to decide for themselves whether the police engaged in wholesale constitutional violation on May 17th,” said Broden
