In both private and business life you can be sure that almost every aspect is covered in one way or another by a law, either directly or indirectly.
If a dispute arises between two parties whether it is personal or business it is often the case that it becomes too personal. The original argument becomes distorted and the parties involved in the dispute start to argue about points which have no relevance to the original argument, the legal aspects of the original dispute are completely forgotten and personal feelings seem to be driving the proceedings. At this stage the dispute runs the risk of becoming violent and as mentioned, the law concerning the main dispute is being ignored with nobody knowing how to apply it to end the dispute both satisfactorily and amicably for both parties.
In the case of a business dispute there will often be a contractual mechanism which must be applied in the event of a disagreement or breach of contract between the two parties. The two parties may decide to resolve the dispute face to face and unfortunately run the risk of slipping into the unsatisfactory situation as described above, in other words allowing personal feelings to govern over the legal issues of the law. If the contract stipulates that legal representation must be used then this avoids the personal conflict situation. In business conflicts the law must be strictly observed otherwise one or both parties could be in conflict with the country law regarding company business. Face to face and toe to toe situations must be avoided when resolving these disputes or disagreements, the obvious solution is regularly ignored.
Personal disputes either between friends, family or neighbours are often regarded as being outside the law because it is between friends or family members so the law does not apply, or so it seems. Once again the obvious solution is ignored.
Sometimes, when one party in a dispute appoints a legal representative it can be seen by the other party as an aggressive move, further deepening the dispute. In reality this is an opportunity for the legal professional to actually bring both sides together and offer a solution for both. It does not always require two lawyers to resolve a private dispute between families or friends, a single friendly law counsellor can resolve matters without either party coming to blows.
With regard to small business a legal counsellor acting for each party can quickly bring resolution to the situation by clarifying the legal situation of each side and bringing a mutual solution. For larger business disputes then perhaps matters may take longer to resolve but the process of trusting a legal counsellor to provide sound advice is the same and in the end an amicable solution is available to both sides.
In resolving disputes of any kind it is almost certain that in some way or another there will be a law which covers the dispute and hence the most efficient and sensible way of concluding matters is to entrust a professional legal counsellor to resolve the issues.
